JH STYLING – KAUPPAEHDOT / TERMS AND CONDITIONS

1. YLEISTÄ

Näitä kauppaehtoja sovelletaan JH Styling -verkkokaupassa tehtäviin tilauksiin sekä JH Stylingilta ostettaviin tuotteisiin ja palveluihin.

Verkkokauppaa ylläpitää HunBun Oy (Y-tunnus 3338579-5), kotipaikka Oulu, Suomi.

Kuluttaja-asiakkaisiin sovelletaan näiden ehtojen lisäksi Suomen pakottavaa kuluttajansuojalainsäädäntöä. Mikään näissä ehdoissa ei rajoita kuluttajalle pakottavan lainsäädännön mukaan kuuluvia oikeuksia.

Yritysasiakkaiden osalta voidaan soveltaa erikseen sovittuja ehtoja.

1. GENERAL

These terms and conditions apply to orders placed through the JH Styling online store and to products and services purchased from JH Styling.

The online store is operated by HunBun Oy (Business ID 3338579-5), domiciled in Oulu, Finland.

Consumer customers are also protected by mandatory Finnish consumer protection legislation. Nothing in these terms and conditions limits any rights granted to consumers under mandatory applicable law.

Separate terms may be agreed with business customers.

3. ASIAKKUUS

JH Styling myy tuotteita kuluttajille ja yrityksille Suomessa sekä niihin maihin, joihin verkkokaupassa kulloinkin tarjotaan toimitus.

Alle 18-vuotias voi tehdä tilauksen vain huoltajansa suostumuksella.

Asiakas vastaa tilausta tehdessään antamiensa tietojen oikeellisuudesta. Näihin kuuluvat muun muassa nimi-, yhteys- ja toimitustiedot sekä tuotteen yhteensopivuuden määrittämiseksi annetut ajoneuvotiedot.

3. CUSTOMERS

JH Styling sells products to consumers and businesses in Finland and to countries to which delivery is offered by the online store at the time of ordering.

Customers under the age of 18 may place an order only with the consent of their legal guardian.

The customer is responsible for ensuring that the information provided when placing an order is correct. This includes, among other things, name, contact and delivery information as well as vehicle information provided for determining product compatibility.

4. TUOTTEET JA TUOTEKUVAT

JH Styling myy muun muassa ajoneuvojen tunnelmavalaistuksia, tähtikattosarjoja, CarPlay- ja multimediatuotteita, styling-tuotteita, lisävarusteita, tuning-osia ja varaosia.

Tuotekuvat ja esimerkkiasennukset pyritään esittämään mahdollisimman tarkasti. Valaistusolosuhteet, näyttölaitteet, ajoneuvon sisustus ja tuotteen eri versiot voivat kuitenkin vaikuttaa esimerkiksi värien ja valaistuksen ulkonäköön.

Valmistaja voi tehdä tuotteeseen vähäisiä teknisiä tai ulkonäöllisiä muutoksia edellyttäen, etteivät tuotteen sovittu käyttötarkoitus, yhteensopivuus tai olennaiset ominaisuudet niiden vuoksi muutu.

Tuotteen tulee aina vastata siitä ennen kaupantekoa annettuja tietoja sekä sovittuja ja lain edellyttämiä ominaisuuksia.

4. PRODUCTS AND PRODUCT IMAGES

JH Styling sells products including vehicle ambient lighting, starlight headliner kits, CarPlay and multimedia products, styling products, accessories, tuning parts and spare parts.

We aim to present product images and example installations as accurately as possible. However, lighting conditions, display devices, vehicle interiors and different product versions may affect the appearance of colours and lighting.

The manufacturer may make minor technical or visual changes to a product provided that such changes do not affect the agreed intended use, compatibility or essential characteristics of the product.

Products must always correspond to the information provided before purchase and to the agreed and legally required characteristics.

5. HINNAT

Hinnat ilmoitetaan verkkokaupassa euroina (€) ja ne sisältävät arvonlisäveron sovellettavan lainsäädännön mukaisesti.

Mahdolliset toimitus- ja muut lisäkulut ilmoitetaan asiakkaalle ennen tilauksen vahvistamista.

JH Styling voi muuttaa tuotteiden hintoja tulevien tilausten osalta.

Ilmeisen hinta- tai kirjoitusvirheen tapauksessa JH Stylingilla on oikeus korjata virhe. Jos virhe koskee jo tehtyä tilausta, asiakkaaseen ollaan yhteydessä ennen tilauksen käsittelyn jatkamista.

5. PRICES

Prices in the online store are stated in euros (€) and include VAT in accordance with applicable legislation.

Any delivery charges and other additional costs are displayed to the customer before the order is confirmed.

JH Styling reserves the right to change prices for future orders.

In the event of an obvious pricing or typographical error, JH Styling has the right to correct the error. If the error concerns an order that has already been placed, the customer will be contacted before further processing of the order.

6. TILAAMINEN JA SOPIMUKSEN SYNTYMINEN

Asiakas valitsee tuotteet, mahdolliset tuotevaihtoehdot ja ajoneuvomallin sekä tarkistaa tilauksen tiedot ennen maksamista.

Asiakkaalle lähetetään tilauksesta tilausvahvistus hänen ilmoittamaansa sähköpostiosoitteeseen.

JH Styling voi perustellusta syystä olla hyväksymättä tilausta esimerkiksi tuotteen saatavuusongelman, ilmeisen hinta- tai järjestelmävirheen, epäillyn väärinkäytöksen tai muun sellaisen syyn vuoksi, jonka perusteella tilausta ei voida kohtuudella toteuttaa. Asiakkaan jo suorittama maksu palautetaan tällöin ilman aiheetonta viivytystä.

6. ORDERING AND FORMATION OF THE CONTRACT

The customer selects the products, any product options and vehicle model and checks the order details before payment.

An order confirmation will be sent to the email address provided by the customer.

JH Styling may decline an order for a justified reason, such as a product availability issue, an obvious pricing or system error, suspected misuse or another reason that makes fulfilment of the order unreasonable or impossible. Any payment already made by the customer will in such cases be refunded without undue delay.

7. MAKSAMINEN

Verkkokaupassa käytettävissä olevat maksutavat näytetään kassalla ja ne voivat vaihdella.

Maksut käsittelee verkkokaupassa ilmoitettu ulkopuolinen maksupalveluntarjoaja.

Asiakkaan maksuun voidaan lisäksi soveltaa kyseisen maksupalveluntarjoajan omia ehtoja.

7. PAYMENT

Available payment methods are displayed at checkout and may vary.

Payments are processed by the third-party payment service provider identified in the online store.

The terms and conditions of the relevant payment service provider may also apply to the customer’s payment.

8. TUOTTEIDEN YHTEENSOPIVUUS

Automallikohtaisissa tuotteissa asiakkaan tulee valita omaa ajoneuvoaan vastaava malli, korimalli, vuosimalli ja tarvittaessa muut pyydetyt tiedot.

Asiakkaan vastuulla on antaa oikeat ajoneuvotiedot.

Jos asiakas on epävarma tuotteen yhteensopivuudesta, yhteensopivuus kannattaa varmistaa JH Stylingilta ennen tilausta.

JH Styling vastaa verkkokaupassa antamiensa yhteensopivuus- ja tuotetietojen oikeellisuudesta lain edellyttämällä tavalla.

JH Styling ei vastaa ylimääräisistä kustannuksista siltä osin kuin ne johtuvat asiakkaan antamista virheellisistä ajoneuvotiedoista tai asiakkaan itse tekemästä väärästä tuotevalinnasta, ellei väärä valinta johdu JH Stylingin antamasta virheellisestä tai puutteellisesta tiedosta.

8. PRODUCT COMPATIBILITY

For vehicle-specific products, the customer must select the model, body type, model year and any other requested information corresponding to their vehicle.

The customer is responsible for providing correct vehicle information.

If the customer is unsure about compatibility, compatibility should be confirmed with JH Styling before placing the order.

JH Styling is responsible for the accuracy of compatibility and product information provided in the online store as required by applicable law.

JH Styling is not responsible for additional costs to the extent that they result from incorrect vehicle information provided by the customer or an incorrect product selection made by the customer, unless the incorrect selection results from incorrect or insufficient information provided by JH Styling.

9. ITSEASENNETTAVAT TUOTTEET

Tuote tulee asentaa tuotteen mukana toimitettujen tai JH Stylingin tai valmistajan ilmoittamien asennusohjeiden mukaisesti.

Ajoneuvon sähköjärjestelmään liitettävien tuotteiden asennuksessa tulee noudattaa erityistä huolellisuutta. Ammattitaitoista asennusta suositellaan silloin, kun tuotteen asentaminen edellyttää ajoneuvon sähköjärjestelmään, johtosarjoihin tai rakenteisiin tehtäviä toimenpiteitä.

JH Styling ei vastaa vahingosta siltä osin kuin vahinko johtuu asiakkaan tai kolmannen osapuolen virheellisestä asennuksesta, väärästä kytkennästä, tuotteen ohjeiden vastaisesta käytöstä, luvattomasta muuttamisesta tai muusta JH Stylingista riippumattomasta menettelystä.

Tämä vastuunrajoitus ei koske tilannetta, jossa virheellinen asennus johtuu JH Stylingin toimittamien asennusohjeiden puutteellisuudesta tai virheellisyydestä taikka tuotteessa itsessään olevasta virheestä.

9. SELF-INSTALLED PRODUCTS

Products must be installed in accordance with the installation instructions supplied with the product or provided by JH Styling or the manufacturer.

Particular care must be taken when installing products connected to a vehicle’s electrical system. Professional installation is recommended when installation requires work on the vehicle’s electrical system, wiring harnesses or structures.

JH Styling is not liable for damage to the extent that it results from incorrect installation by the customer or a third party, incorrect wiring, use contrary to the instructions, unauthorised modification of the product or other conduct outside JH Styling’s control.

This limitation does not apply where incorrect installation results from deficient or incorrect installation instructions provided by JH Styling or from a defect in the product itself.

10. JH STYLINGIN ASENNUSPALVELU

Jos asiakas ostaa JH Stylingilta tuotteen asennettuna, JH Styling vastaa oman asennustyönsä asianmukaisesta suorittamisesta sovitun mukaisesti ja lain edellyttämällä tavalla.

Asiakkaan tulee ennen asennusta ilmoittaa JH Stylingille tiedossaan olevista ajoneuvon vioista, muutoksista, jälkiasennetuista laitteista ja muista seikoista, jotka voivat olennaisesti vaikuttaa asennustyöhön.

JH Styling ei vastaa ajoneuvossa ennen työn aloittamista olleesta viasta tai sellaisesta myöhemmin ilmenevästä viasta, joka ei johdu JH Stylingin toimittamasta tuotteesta tai tekemästä asennustyöstä.

Jos asennuksen aikana havaitaan ennalta arvaamaton seikka, joka estää sovitun työn turvallisen tai asianmukaisen suorittamisen tai edellyttää olennaisia lisätöitä, asiakkaaseen ollaan mahdollisuuksien mukaan yhteydessä ennen lisätöiden tekemistä.

10. JH STYLING INSTALLATION SERVICE

If the customer purchases a product installed by JH Styling, JH Styling is responsible for carrying out its installation work properly, as agreed and as required by applicable law.

Before installation, the customer must inform JH Styling of any known faults, modifications, aftermarket equipment or other circumstances concerning the vehicle that may materially affect the installation work.

JH Styling is not responsible for faults that existed in the vehicle before the work began or for faults discovered later that were not caused by a product supplied by JH Styling or by JH Styling’s installation work.

If an unforeseen circumstance is discovered during installation that prevents the agreed work from being carried out safely or properly or requires substantial additional work, the customer will, where reasonably possible, be contacted before additional work is performed.

11. TUOTTEIDEN KÄYTTÖ JA TIELIIKENNEKELPOISUUS

Asiakkaan tulee käyttää tuotetta sen käyttötarkoituksen ja annettujen ohjeiden mukaisesti.

Osa styling- ja tuning-tuotteista voi olla tarkoitettu vain näyttely-, kilpailu-, rata- tai muuhun tieliikenteen ulkopuoliseen käyttöön. Tällaisesta rajoituksesta ilmoitetaan tuotetiedoissa silloin, kun rajoitus on tiedossa ja tuotteeseen sovellettavissa.

Ajoneuvojen rakentamista, valaistusta ja varusteita koskevat määräykset voivat vaihdella ajoneuvon ja käyttömaan mukaan.

Asiakkaan vastuulla on huolehtia siitä, että hänen ajoneuvonsa ja siihen tehdyt muutokset täyttävät sovellettavat käyttö-, katsastus- ja tieliikennevaatimukset. Tämä ei rajoita JH Stylingin vastuuta tuotteen markkinoinnissa tai tuotetiedoissa annettujen tietojen oikeellisuudesta.

11. PRODUCT USE AND ROAD LEGALITY

The customer must use the product for its intended purpose and in accordance with the instructions provided.

Some styling and tuning products may be intended only for show, competition, track or other off-road use. Where such a restriction is known and applicable to a product, it will be stated in the product information.

Regulations concerning vehicle construction, lighting and equipment may vary depending on the vehicle and the country in which it is used.

The customer is responsible for ensuring that their vehicle and any modifications made to it comply with applicable use, inspection and road traffic requirements. This does not limit JH Styling’s responsibility for the accuracy of information provided in product descriptions or marketing.

12. TOIMITUS

Käytettävissä olevat toimitustavat, toimituskulut ja mahdollinen arvioitu toimitusaika ilmoitetaan verkkokaupassa tai tilauksen yhteydessä.

Toimitusaika voi vaihdella tuotteen, automallin, saatavuuden ja toimitusmaan mukaan.

Jos tilauksen toimittaminen viivästyy olennaisesti, asiakkaalle ilmoitetaan asiasta mahdollisuuksien mukaan.

JH Styling vastaa toimituksen viivästymisestä sovellettavan kuluttajansuojalainsäädännön mukaisesti.

12. DELIVERY

Available delivery methods, delivery charges and any estimated delivery time are stated in the online store or during the ordering process.

Delivery times may vary depending on the product, vehicle model, availability and destination country.

If delivery is materially delayed, the customer will be informed where reasonably possible.

JH Styling is responsible for delivery delays in accordance with applicable consumer protection legislation.

13. NOUTAMATTA JÄTETTY LÄHETYS

Paketin noutamatta jättäminen ei itsessään ole peruuttamisilmoitus. Asiakkaan tulee ilmoittaa sopimuksen peruuttamisesta erikseen.

Jos asiakas jättää lähetyksen noutamatta tekemättä peruuttamisilmoitusta, JH Styling voi lain sallimissa rajoissa periä asiakkaalta tästä aiheutuneet todelliset ja välittömät toimitus-, palautus- ja kohtuulliset käsittelykustannukset.

13. UNCOLLECTED SHIPMENTS

Failure to collect a parcel does not in itself constitute a notice of cancellation. The customer must separately notify JH Styling of the cancellation of the contract.

If the customer fails to collect a shipment without submitting a notice of cancellation, JH Styling may, to the extent permitted by law, charge the customer for the actual and direct delivery, return and reasonable handling costs incurred as a result.

14. KULUTTAJAN PERUUTTAMISOIKEUS

Kuluttaja-asiakkaalla on etämyynnissä pääsääntöisesti oikeus peruuttaa tavaraa koskeva sopimus 14 päivän kuluessa tavaran vastaanottamisesta ilman erityistä syytä.

Peruuttamisesta on tehtävä selkeä ilmoitus JH Stylingille määräajan kuluessa.

Pelkkä tuotteen palauttaminen tai lähetyksen noutamatta jättäminen ei ole peruuttamisilmoitus..

14. CONSUMER RIGHT OF CANCELLATION

In distance sales, consumer customers generally have the right to cancel a contract for goods within 14 days of receiving the goods without giving a reason.

The customer must provide JH Styling with a clear notice of cancellation within the applicable time limit.

A notice of cancellation can be submitted by email to info@jhstyling.fi.

Simply returning the product or failing to collect a shipment does not constitute a notice of cancellation.

15. TAVARAN PALAUTTAMINEN

Peruuttamisilmoituksen jälkeen tavara tulee palauttaa ilman aiheetonta viivytystä ja viimeistään 14 päivän kuluessa peruuttamisilmoituksen tekemisestä.

Asiakas vastaa palautuksen välittömistä kustannuksista, ellei JH Styling ole erikseen ilmoittanut vastaavansa niistä. Palautuksesta ja sen kustannuksista annetaan asiakkaalle tarvittavat ohjeet peruuttamisen yhteydessä.

Tuote tulee pakata palautusta varten huolellisesti siten, ettei se vahingoitu kuljetuksessa.

Alkuperäisen pakkauksen käyttämistä suositellaan mahdollisuuksien mukaan. Alkuperäisen pakkauksen avaaminen tai puuttuminen ei kuitenkaan sellaisenaan poista kuluttajan lakisääteistä peruuttamisoikeutta.

Asiakkaan tulee säilyttää palautuksesta saamansa kuitti tai muu tosite siihen asti, kunnes palautus on käsitelty.

Palautusta ei tule lähettää postiennakolla ilman JH Stylingin etukäteen antamaa kirjallista suostumusta.

15. RETURNING GOODS

Following a notice of cancellation, the goods must be returned without undue delay and no later than 14 days after the notice of cancellation was submitted.

The customer is responsible for the direct cost of returning the goods unless JH Styling has separately agreed to bear those costs. Necessary return instructions and information concerning costs will be provided in connection with the cancellation.

The product must be carefully packaged for return so that it is not damaged during transport.

Use of the original packaging is recommended where possible. However, opening or no longer having the original packaging does not in itself remove the consumer’s statutory right of cancellation.

The customer should retain the receipt or other proof of return until the return has been processed.

Returns must not be sent cash on delivery without JH Styling’s prior written consent.

16. TUOTTEEN KOKEILEMINEN JA ARVONALENNUS

Kuluttajalla on oikeus tutustua tavaraan ja tarkastaa sen ominaisuudet tavalla, joka on tarpeen tavaran luonteen, ominaisuuksien ja toimivuuden toteamiseksi.

Jos tuotetta käsitellään enemmän kuin tämän toteamiseksi on tarpeen ja tuotteen arvo tämän vuoksi alenee, asiakas vastaa aiheutuneesta arvonalennuksesta lain mukaisesti.

Autokohtaisten valaistus-, elektroniikka- ja styling-tuotteiden osalta esimerkiksi johtojen katkaiseminen tai muuttaminen, kiinnityspintojen pysyvä muuttaminen, osien liimaaminen, tuotteen asentaminen ajoneuvoon tai muu vastaava käyttöönotto voi tapauskohtaisesti alentaa tuotteen jälleenmyyntiarvoa.

Arvonalennus arvioidaan aina tapauskohtaisesti.

16. INSPECTION OF GOODS AND DIMINISHED VALUE

A consumer has the right to inspect goods and determine their characteristics to the extent necessary to establish the nature, characteristics and functioning of the goods.

If the product is handled beyond what is necessary for this purpose and its value is reduced as a result, the customer is responsible for the diminished value in accordance with applicable law.

For vehicle-specific lighting, electronics and styling products, actions such as cutting or modifying wires, permanently modifying mounting surfaces, gluing components, installing the product in a vehicle or other comparable use may, depending on the circumstances, reduce the resale value of the product.

Any diminished value will always be assessed on a case-by-case basis.

17. PERUUTTAMISOIKEUDEN POIKKEUKSET

Peruuttamisoikeutta ei ole niissä tilanteissa, joissa sovellettava laki nimenomaisesti säätää poikkeuksesta.

Tällainen voi olla esimerkiksi tuote, joka valmistetaan tai jota muunnellaan asiakkaan vaatimusten mukaisesti tai joka tehdään selvästi henkilökohtaisia tarpeita vastaavaksi.

Pelkkä automallin, värin tai muun valmiiseen perusvalikoimaan kuuluvan vaihtoehdon valitseminen ei kuitenkaan automaattisesti tee tuotteesta peruuttamisoikeuden ulkopuolelle jäävää mittatilaustuotetta.

Jos tietyn JH Styling -tuotteen peruuttamisoikeus puuttuu lain mukaisen poikkeuksen perusteella, tästä ilmoitetaan asiakkaalle selkeästi ennen tilauksen tekemistä.

17. EXCEPTIONS TO THE RIGHT OF CANCELLATION

The right of cancellation does not apply in situations where applicable law expressly provides an exception.

Such an exception may apply, for example, to a product manufactured or modified according to the customer’s specifications or clearly personalised to meet the customer’s individual needs.

However, merely selecting a vehicle model, colour or another option from the standard range does not automatically make a product a customised item excluded from the right of cancellation.

If the right of cancellation does not apply to a particular JH Styling product due to a statutory exception, the customer will be clearly informed before placing the order.

18. ASENNUSPALVELUN PERUUTTAMINEN

Etänä tilatulla asennuspalvelulla on kuluttajansuojalainsäädännön mukainen peruuttamisoikeus.

Jos asiakas pyytää nimenomaisesti asennuspalvelun aloittamista ennen 14 päivän peruuttamisajan päättymistä ja peruuttaa sopimuksen työn aloittamisen jälkeen, JH Stylingilla on lain edellytysten täyttyessä oikeus kohtuulliseen korvaukseen peruuttamishetkeen mennessä suoritetusta palvelun osasta.

Kun palvelu on asiakkaan nimenomaisesta pyynnöstä suoritettu kokonaan ja asiakas on asianmukaisesti hyväksynyt peruuttamisoikeuden menettämisen palvelun tultua kokonaan suoritetuksi, palvelua koskeva peruuttamisoikeus päättyy lain mukaisesti.

18. CANCELLATION OF INSTALLATION SERVICES

Installation services ordered at a distance are subject to the cancellation rights provided by applicable consumer protection legislation.

If the customer expressly requests that the installation service begin before the end of the 14-day cancellation period and subsequently cancels the contract after performance has begun, JH Styling may, where the statutory requirements are met, charge a reasonable amount for the part of the service performed up to the time of cancellation.

Where the service has been fully performed at the customer’s express request and the customer has properly acknowledged that the right of cancellation will be lost once the service has been fully performed, the right to cancel the service ends in accordance with applicable law.

19. MAKSUJEN PALAUTTAMINEN

Peruuttamistilanteessa JH Styling palauttaa kuluttajalta saamansa palautettavat maksut ilman aiheetonta viivytystä ja viimeistään 14 päivän kuluttua peruuttamisilmoituksen vastaanottamisesta lain mukaisesti.

Tavarakaupassa JH Styling voi lain sallimissa tilanteissa pidättäytyä maksujen palautuksesta, kunnes palautettava tavara on vastaanotettu tai kuluttaja osoittaa lähettäneensä tavaran takaisin.

Palautus tehdään lähtökohtaisesti samalla maksutavalla, jota asiakas käytti alkuperäisessä maksussa, ellei muusta sovita. Maksun palautuksesta ei aiheuteta kuluttajalle ylimääräisiä kustannuksia.

Jos asiakas on valinnut JH Stylingin tarjoamaa edullisinta vakiotoimitusta kalliimman toimitustavan, JH Stylingin ei tarvitse palauttaa tästä aiheutunutta ylimääräistä toimituskustannusta.

19. REFUNDS

In the event of cancellation, JH Styling will refund the refundable payments received from the consumer without undue delay and no later than 14 days after receiving the notice of cancellation, in accordance with applicable law.

For the sale of goods, JH Styling may, where permitted by law, withhold the refund until the returned goods have been received or the consumer provides evidence that the goods have been sent back.

Refunds will generally be made using the same payment method used for the original transaction unless otherwise agreed. The consumer will not incur additional charges as a result of the refund.

If the customer selected a delivery method more expensive than the least expensive standard delivery method offered by JH Styling, JH Styling is not required to refund the additional delivery cost.

20. VIRHEVASTUU

JH Styling vastaa myymiensä tuotteiden virheistä sovellettavan kuluttajansuojalainsäädännön mukaisesti.

Tuotteessa voi olla virhe esimerkiksi silloin, jos se ei vastaa sovittua, annettuja tuotetietoja tai niitä ominaisuuksia ja vaatimuksia, joita kuluttajalla on lain mukaan perusteltua aihetta odottaa.

Lakisääteistä virhevastuuta ei rajoiteta takuuehdoilla tai näillä kauppaehdoilla.

Virhetilanteessa JH Stylingilla on oikeus ja velvollisuus selvittää virhe sekä oikaista se lain mukaisesti. Virheen ensisijaisia oikaisukeinoja ovat lain edellytysten mukaisesti tuotteen korjaaminen tai vaihtaminen virheettömään. Muut mahdolliset seuraamukset määräytyvät sovellettavan kuluttajansuojalainsäädännön mukaan.

20. STATUTORY LIABILITY FOR DEFECTS

JH Styling is responsible for defects in products it sells in accordance with applicable consumer protection legislation.

A product may be defective, for example, if it does not correspond to what was agreed, to the product information provided or to the characteristics and requirements that a consumer may reasonably expect under applicable law.

Statutory liability for defects is not limited by warranty terms or by these terms and conditions.

Where a defect exists, JH Styling has the right and obligation to investigate and remedy the defect in accordance with applicable law. The primary remedies are, where the statutory requirements are met, repair of the product or replacement with a non-defective product. Any other remedies are determined in accordance with applicable consumer protection legislation.

21. TAKUU

Mahdollinen tuotekohtainen takuu ja sen kesto ilmoitetaan tuotetiedoissa tai tuotteen mukana toimitettavissa tiedoissa.

Takuu on vapaaehtoinen lisäetu eikä se rajoita asiakkaan lakisääteistä virhevastuuta.

Takuu ei lähtökohtaisesti kata vikaa, jonka voidaan osoittaa johtuneen esimerkiksi tuotteen väärästä käsittelystä, virheellisestä asennuksesta, onnettomuudesta, ohjeiden vastaisesta käytöstä tai asiakkaan tekemästä tuotteeseen kohdistuvasta muutoksesta.

Takuu- tai virhevastuuta ei kuitenkaan voida evätä pelkästään sillä perusteella, että asiakas on asentanut tuotteen itse tai käyttänyt ulkopuolista asentajaa, jos kyseinen seikka ei ole aiheuttanut todettua vikaa.

21. WARRANTY

Any product-specific warranty and its duration are stated in the product information or in information supplied with the product.

A warranty is a voluntary additional benefit and does not limit the customer’s statutory rights regarding defective goods.

As a general rule, a warranty does not cover a fault that can be shown to have resulted, for example, from improper handling, incorrect installation, an accident, use contrary to the instructions or a modification made to the product by the customer.

However, warranty or statutory defect liability cannot be denied solely because the customer installed the product themselves or used a third-party installer if that circumstance did not cause the identified fault.

22. REKLAMAATIOT

Jos tuotteessa tai JH Stylingin suorittamassa palvelussa ilmenee virhe, asiakkaan tulee ilmoittaa siitä JH Stylingille kohtuullisessa ajassa virheen havaitsemisesta.

Asian käsittelyn nopeuttamiseksi asiakkaan kannattaa ilmoittaa tilausnumero, ajoneuvon tiedot, kuvaus ongelmasta sekä mahdollisuuksien mukaan valokuvat tai video havaitusta viasta.

Asiakkaan tulee antaa JH Stylingille kohtuullinen mahdollisuus tutkia väitetty virhe ennen kuin tuotteeseen tehdään sellaisia muutoksia tai korjauksia, jotka voivat vaikeuttaa virheen syyn selvittämistä. Tämä ei rajoita kuluttajan pakottavia lakisääteisiä oikeuksia.

22. COMPLAINTS

If a defect is discovered in a product or service provided by JH Styling, the customer should notify JH Styling within a reasonable time after discovering the defect.

Complaints may be submitted by email to:

To facilitate processing, the customer should provide the order number, vehicle information, a description of the problem and, where possible, photographs or video showing the defect.

The customer should give JH Styling a reasonable opportunity to investigate the alleged defect before modifications or repairs are made that could make determining the cause of the defect more difficult. This does not limit the consumer’s mandatory statutory rights.

23. VASTUU VAHINGOISTA

JH Styling vastaa tuotteesta tai palvelusta aiheutuneista vahingoista sovellettavan pakottavan lainsäädännön mukaisesti.

JH Styling ei vastaa vahingosta siltä osin kuin vahinko johtuu asiakkaan tai kolmannen osapuolen menettelystä, kuten todetusti virheellisestä asennuksesta, väärästä kytkennästä, ohjeiden vastaisesta käytöstä tai tuotteeseen tehdystä muutoksesta, eikä kyseinen vahinko johdu JH Stylingin vastuulle kuuluvasta tuotteen, palvelun tai ohjeistuksen virheestä.

Näitä ehtoja ei sovelleta tavalla, joka rajoittaisi kuluttajan pakottavaan lainsäädäntöön perustuvaa oikeutta korvaukseen.

23. LIABILITY FOR DAMAGE

JH Styling is liable for damage caused by a product or service in accordance with applicable mandatory law.

JH Styling is not liable for damage to the extent that the damage results from the actions of the customer or a third party, such as demonstrably incorrect installation, incorrect wiring, use contrary to instructions or modification of the product, and the damage is not caused by a defect in the product, service or instructions for which JH Styling is responsible.

These terms shall not be applied in a manner that limits a consumer’s right to compensation under mandatory applicable law.

24. YLIVOIMAINEN ESTE

JH Styling ei vastaa viivästyksestä tai sopimusvelvoitteen täyttämättä jäämisestä siltä osin kuin se johtuu JH Stylingin kohtuullisen vaikutusmahdollisuuden ulkopuolella olevasta ennalta arvaamattomasta esteestä, jonka seurauksia ei kohtuudella voida välttää.

Tällaisia voivat tilanteesta riippuen olla esimerkiksi vakava kuljetushäiriö, viranomaisen toimenpide, laaja tietoliikennehäiriö, luonnonkatastrofi, sota tai muu vastaava poikkeuksellinen tapahtuma.

Kuluttajan oikeudet tällaisessa tilanteessa määräytyvät kuitenkin aina sovellettavan pakottavan lainsäädännön mukaisesti.

24. FORCE MAJEURE

JH Styling is not liable for delay or failure to perform a contractual obligation to the extent that it results from an unforeseeable event outside JH Styling’s reasonable control and the consequences of which could not reasonably have been avoided.

Depending on the circumstances, such events may include serious transport disruption, action by public authorities, major telecommunications disruption, natural disaster, war or another comparable exceptional event.

The consumer’s rights in such circumstances are nevertheless always determined by applicable mandatory law.

25. SOVELLETTAVA LAKI JA RIIDANRATKAISU

Näihin kauppaehtoihin ja JH Stylingin kanssa tehtäviin sopimuksiin sovelletaan Suomen lakia. Kuluttajan oman asuinmaan pakottavan kuluttajansuojalainsäädännön hänelle tarjoamia oikeuksia ei tällä lainvalinnalla rajoiteta.

Mahdolliset erimielisyydet pyritään ensisijaisesti ratkaisemaan asiakkaan ja JH Stylingin välisillä neuvotteluilla.

Jos kuluttajan ja JH Stylingin välistä erimielisyyttä ei saada ratkaistuksi neuvotteluilla, kuluttaja voi olla yhteydessä kuluttajaneuvontaan ja tämän jälkeen saattaa asian Kuluttajariitalautakunnan käsiteltäväksi.

25. APPLICABLE LAW AND DISPUTE RESOLUTION

These terms and conditions and contracts concluded with JH Styling are governed by Finnish law. This choice of law does not deprive a consumer of any mandatory consumer protection rights provided by the law of the consumer’s country of residence.

Any disputes should primarily be resolved through negotiations between the customer and JH Styling.

If a dispute between a consumer and JH Styling cannot be resolved through negotiations, the consumer may contact Finnish Consumer Advisory Services and thereafter refer the matter to the Finnish Consumer Disputes Board.
